PLEASE READ THESE TERMS OF USE AND SALE ("TERMS") CAREFULLY BEFORE ORDERING ONLINE OR USING THIS WEBSITE. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND ECOMMERCE PRODUCTIONS (sole proprietorship, KVK 77997859), trading under the brand name 1, 2324JP Leiden, Netherlands. By using the website or placing an order, you confirm that you have read and agree to these terms and conditions.

If you do not agree to these terms and conditions, please do not use the website or place an order.

2.2 You can cancel or pause your subscription at any time. To avoid a subsequent direct debit, you must cancel no later than the last day of your billing period. You can cancel by email to hello@xodil.com or via your account. Cancellations are effective at the end of the current billing period.

2.3 You are obliged to provide current, complete and correct information for your payment account. You must report any changes to billing or delivery address, payment method or other information in a timely manner via hello@xodil.com.

2.4 We reserve the right to change subscription prices. Price changes only apply to future renewals. You will receive notification by email at least 30 days in advance. If you do not agree, you can cancel before the price change takes effect.

We are committed to providing high-quality products, and we want New Customers (as defined below) to have a risk-free opportunity to try our products. That is why we offer a 90-day money-back guarantee (“Guarantee”) on your first purchase.

This Guarantee applies to new customers only and is valid for both one-off purchases and Subscriptions. A “New Customer” is defined as someone who has not previously made any purchases from Xodil, uses a unique email address, payment method that has not been associated with prior purchases, and resides in a household that has not previously placed an order.

If, after 30 days of consistent use, you are not satisfied with the results, you can request a refund within 90 days of your purchase.

To request a refund, email us at hello@xodil.com with your name, order number, and the date of your purchase. Refunds will be processed as soon as possible and always within 90 days of receiving your refund request. Please note that this Guarantee only applies to your first purchase, covers only the cost of the product (excluding shipping costs), and can only be exercised once per household.

For all purchases, you can return the products within 30 days of your order with us by emailing hello@xodil.com. In this email you shall provide your name, your order number, the date of your order and your address. We will then tell you via return email how and to which address you need to return the product to us in order to receive your refund. Your return shipment will require tracking by the carrier to the return address we have provided to you. You must provide us with the tracking number immediately after dispatch by emailing hello@xodil.com. Please note that the return shipping costs cannot be reimbursed by us unless required so under applicable law. Refunds will be made as soon as possible and always within 6 weeks of our receipt of the returned product.

Subject to the limitations set forth herein, you or third parties may be able to upload or submit photographs, comments, video clips, reviews, and other communications and content to us (either directly or through our partners) and the website (“Your Content” or “Third-Party Content”, as applicable). Unless we indicate otherwise, by posting or submitting Your Content to the website, you grant Xodil and its affiliates are free to use any ideas, concepts or know-how contained in Your Content for any purpose whatsoever including, but not limited to, developing, manufacturing, distributing and marketing products using such information. Xodil is under no obligation (i) to maintain Your Content in confidence; (ii) to pay to you or any third party any compensation for any Your Content; or (iii) to respond to any Your Content. You are and shall remain solely responsible for Your Content.

You represent and warrant that (a) you own or otherwise control all of the rights to Your Content; (b) that Your Content is accurate; and (c) that use of Your Content does not violate this Agreement and will not cause injury to any person or entity.

We will not be responsible or liable to you or to any third party in any way for the content, or completeness, accuracy, or liability of Your or Third-Party Content, including, but not limited to, for any errors or omissions in any Your or Third-Party Content, or for any loss or damage of any kind incurred as a result of the use of any such Your or Third-Party Content. Xodil has the right, but not the obligation, in its sole discretion, to monitor and edit or remove any activity or content or take legal action against you or the third party responsible for such content. Any content, views, opinions, comments, or questions/responses expressed, submitted, published, posted, uploaded, or otherwise transmitted by third parties or other users through or in connection with the website, Xodil, or its products, are solely the views, opinions and responsibility of the parties expressing, submitting, publishing, posting, uploading, or transmitting them and do not necessarily reflect the opinions of Xodil. Xodil takes no responsibility and assumes no liability for any Your or Third-Party Content.

You hereby authorize Xodil and its third-party service providers to derive statistical and usage data relating to your use of the website or products (“Usage Data”). We may use Usage Data for any purpose in accordance with applicable law and our Privacy Policy. Any questions, comments, suggestions, ideas, feedback, reviews, or other information about the website or products (“Submissions”), provided by you to Xodil are non-confidential and Xodil will be entitled to the unrestricted use and dissemination of these Submissions for any purposes, commercial or otherwise, without acknowledgment, attribution, or compensation to you.

(g) not to deeplink to de website without Xodil’s express written consent;

(h) not to create or use a false identity on de website, share your account information, or allow any person besides yourself to use your account to access de website;

(i) not use de website to collect or store personal data about others;

(j) not to attempt to obtain ongeautoriseerd access to de website or portions of de website that are restricted from general access;

BECAUSE SOME JURISDICTIONS (INCLUDING, WITHOUT LIMITATION, THE STATE OF NEW JERSEY) PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU OR BE ENFORCEABLE WITH RESPECT TO YOU, AND IF YOU ARE A USER FROM SUCH JURISDICTIONS, THE FOREGOING SECTIONS TITLED “DISCLAIMER OF WARRANTIES” AND “LIMITATION OF LIABILITY” ARE INTENDED TO BE ONLY AS BROAD AS IS PERMITTED UNDER THE LAWS OF SUCH JURISDICTION. IF ANY PORTION OF THESE SECTIONS IS HELD TO BE INVALID UNDER THE LAWS OF SUCH JURISDICTION, THE INVALIDITY OF SUCH PORTION WILL NOT AFFECT THE VALIDITY OF THE REMAINING PORTIONS OF THE APPLICABLE SECTIONS. Following termination, you will not be permitted to use the website and Xodil may, in our discretion, cancel any outstanding orders for the product.

17.1 Dutch law applies to these conditions.

17.2 Disputes between you and Ecommerce Productions are preferably resolved by mutual agreement. If that doesn't work, you can file a complaint via hello@xodil.com. Consumers can also use the EU platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr.

17.3 If a dispute is not resolved amicably, it will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.

18.1 EU consumers enjoy the rights under applicable consumer law, including the right to withdraw within 14 days where applicable.

In addition to these terms and conditions, your purchase of products through the website is subject to the Privacy Policy, which is incorporated herein by reference.

Disputes that do not fall under the provisions of section 17 will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.

Notwithstanding the arbitrage agreement contained in this Agreement, in bestelling to avoid irreparable injury to Xodil, in the event of any breach or threatened breach by you of the provisions of this Agreement, we shall be entitled to seek an injunction and other equitable relief restraining such breach in any court of competent jurisdiction. Nothing in this Agreement shall be construed as prohibiting Xodil from pursuing any other remedies available to it for such breach or threatened breach, including the recovery of monetary damages from you.

Xodil may assign, transfer, or sub-contract any of our rights or obligations under these terms and conditions to any third party at our discretion.

No delay by Xodil in exercising any right or remedy under these conditions shall operate as a waiver of that right or remedy or shall affect Xodil's ability to subsequently exercise that right or remedy. These terms and conditions (together with any terms incorporated by reference herein) constitute the entire agreement between you and Xodil relating to the subject matter herein. Any waiver must be agreed to by Xodil in writing. These terms and conditions supersede any other terms previously published by us and any other representations or statements made by us to you, whether oral, written, or otherwise.
